WHAT HAPPENS WHEN YOUR ASYLUM IS REJECTED BY SCRA?

WHAT IS AN ASYLUM SEEKER PERMIT
If you have fled your country of origin for fear of persecution, and you do not have legal documents such as a passport or visa, you must apply for an asylum seeker’s permit at the nearest Refugee Reception Office (RRO). The asylum seeker’s permit is a temporary permit which you are given pending a decision on your application for refugee status or for asylum.
If your asylum application is approved, you will be given a Section 24 permit (also known as a “Refugee Permit”) which officially recognises you as a refugee and is valid for two years. The permit may be renewed. You can apply for a permanent residence permit if you have lived in South Africa for more than five years on a refugee status permit.

HOW TO APPLY FOR AN ASYLUM SEEKER PERMIT
From the time you enter the boarders of South Africa through a port of entry (a land border post, airport or harbor), you may claim to be an asylum seeker and you will, therefore, be issued with a section 23 Permits which is a non – renewable “asylum transit permit” of the Immigration Act. This permit is valid for a 14 days period only and authorizes the holder to report to the nearest Refugee Reception Office in order to apply for asylum in terms of section 21 of the Refugee Act. The most commonly visited offices are: Pretoria, Musina, Capetown and Durban.
On your arrival, there are various stages you may have to engage in, including an interview and an assessment of the circumstances surrounding the persecution you face from your country of origin.
Your fingerprints will be taken in the prescribed manner, and an Interpreter if secured (needed).
Firstly interview will conducted by a Refugee Reception Officer (RRO) and BI-1590 form duly completed. Your personal data and image will be captured in the refugee system, An Asylum Seeker’s permit (a section 22 permit) will the be printed, signed, stamped and issued you.
IN THE APPLICATION, HOW AN ASYLUM SEEKER PERMIT JUDGED?
The asylum seeker permit typically lasts a period of 2 to 3 years. If the standing committee is satisfied that the circumstances surrounding the persecution from your country of origin warrant refugee status, you will then be granted with a refugee permit. Which typically lasts a period of 5 years or more.

WHEN APPLYING FOR AN ASYLUM SEEKER PERMIT, WHAT DO I HAVE TO SUBMIT?
For all new asylum applicants, the following documents are needed:
- A section 23 permit
- Any proof of identification from the country of origin
- A travel document if in possession of one
WILL I BE ABLE TO WORK, STUDY OR RUN A BUSINESS IN THE COUNTRY?
The asylum seeker’s permit which is valid for a period of six months legalizes the asylum seeker stay in South Africa temporarily pending a final decision on his application. The permit can be extended by a Refugee Reception Officer for a further six months while the process of status determination is in progress.
The holder of a section 22 asylum seeker’s permit has the right to work and study in South Africa and is protected against deportation to his country of origin.
